happiness is abstract. even if it is a right, who will give u the rights? constitution? government? they don't have the power to give u happiness. secondly, happiness is different for different ppl. one which is happiness for you cannot be happiness for others. thirdly, it is upon us to decide whether u should live happily or not. it is not possible to be happy all the time. hence, happiness cannot be stated as right.
Happiness is too vague of a concept to be a right. If having a safe home makes you happy, that is a right. If torturing small animals makes you happy, that is not only not a right it us a crime.
